JustVR服务条款 | JustVR Terms of Service

欢迎使用JustVR（以下简称“本应用”或“平台”）提供的虚拟现实视频服务。本服务条款（以下简称“本条款”）构成你与JustVR运营方（以下简称“我们”）之间关于使用本应用服务的法律协议。你通过下载、安装、注册、登录或使用本应用的任何服务，即表示你已充分阅读、理解并同意接受本条款的全部内容。如你不同意本条款，请勿使用本应用。
Welcome to the virtual reality video services provided by JustVR (hereinafter referred to as "this Application" or "the Platform"). These Terms of Service (hereinafter referred to as "these Terms") constitute a legal agreement between you and the operator of JustVR (hereinafter referred to as "we") regarding your use of the services of this Application. By downloading, installing, registering, logging in, or using any services of this Application, you represent that you have fully read, understood, and agreed to be bound by all the contents of these Terms. If you do not agree to these Terms, please do not use this Application.

一、服务使用规范 | I. Service Usage Norms

你承诺在使用本应用服务时，严格遵守国家法律法规、行业规范及本条款的约定，不得实施任何损害本应用、其他用户合法权益或违反公序良俗的行为。具体禁止行为包括但不限于：
You undertake to strictly comply with national laws and regulations, industry norms, and the provisions of these Terms when using the services of this Application, and shall not engage in any acts that damage the legitimate rights and interests of this Application, other users, or violate public order and good morals. Specific prohibited acts include but are not limited to:

1.1 禁止技术攻击行为 | 1.1 Prohibition of Technical Attack Acts

不得通过任何技术手段对本应用的服务器、网络系统、数据库、服务接口等进行攻击、侵入、干扰或破坏，包括但不限于：
You shall not attack, intrude, interfere with, or damage the servers, network systems, databases, service interfaces, etc. of this Application through any technical means, including but not limited to:

• 发起DDoS攻击、暴力破解、SQL注入、跨站脚本攻击（XSS）等网络攻击行为；
  Launching DDoS attacks, brute force cracking, SQL injection, cross-site scripting (XSS) and other network attack acts;
• 利用爬虫程序、机器人脚本等恶意抓取本应用数据或干扰服务正常运行；
  Using crawler programs, robot scripts, etc. to maliciously crawl data of this Application or interfere with the normal operation of the services;
• 伪造请求、篡改网络数据包或其他破坏服务稳定性的行为。
  Forging requests, tampering with network data packets, or other acts that damage the stability of the services.

1.2 禁止对应用进行篡改与逆向工程 | 1.2 Prohibition of Tampering and Reverse Engineering of the Application

不得对本应用的软件程序、代码、界面、功能等进行任何形式的修改、破解、反编译、反汇编、逆向工程或篡改，包括但不限于：
You shall not modify, crack, decompile, disassemble, reverse engineer, or tamper with the software programs, codes, interfaces, functions, etc. of this Application in any form, including but not limited to:

• 对本应用的安装包、安装文件进行破解、修改，以绕过付费、广告或功能限制；
  Cracking or modifying the installation package or installation files of this Application to bypass payment, advertising, or function restrictions;
• 对本应用的运行代码进行反编译、反汇编，获取源代码或核心算法；
  Decompiling or disassembling the running code of this Application to obtain source code or core algorithms;
• 制作、传播本应用的破解版、修改版、盗版或衍生程序；
  Creating or distributing cracked, modified, pirated, or derivative programs of this Application;
• 篡改本应用的显示内容、数据统计或功能逻辑。
  Tampering with the display content, data statistics, or functional logic of this Application.

二、内容版权保护 | II. Content Copyright Protection

本应用提供的所有视频内容（包括但不限于原创VR视频、合作授权视频等，以下简称“平台内容”）均受《中华人民共和国著作权法》及国际版权条约保护，采用知识共享署名-非商业性使用 4.0 国际许可协议（CC BY-NC 4.0）进行授权。
All video content provided by this Application (including but not limited to original VR videos, cooperatively authorized videos, etc., hereinafter referred to as "Platform Content") is protected by the Copyright Law of the People's Republic of China and international copyright treaties, and is licensed under the Creative Commons Attribution-NonCommercial 4.0 International License (CC BY-NC 4.0).

CC BY-NC 4.0 核心要求 | Core Requirements of CC BY-NC 4.0：
1. 署名（Attribution）：任何形式的转载、传播、使用平台内容，必须清晰标注内容作者及来源（JustVR平台）；
1. Attribution: Any reproduction, dissemination, or use of Platform Content in any form must clearly mark the author of the content and the source (JustVR Platform);
2. 非商业性使用（NonCommercial）：不得将平台内容用于任何商业目的，包括但不限于广告投放、付费点播、产品宣传、商业演出等；
2. NonCommercial: You shall not use Platform Content for any commercial purposes, including but not limited to advertising, pay-per-view, product promotion, commercial performances, etc.;
3. 商用授权：如你需将平台内容用于商业目的，必须事先与内容作者取得书面授权，并按照作者要求支付相应的版权费用。
3. Commercial Authorization: If you need to use Platform Content for commercial purposes, you must obtain written authorization from the content author in advance and pay the corresponding copyright fees in accordance with the author's requirements.

具体使用规则如下：
The specific usage rules are as follows:

• 非商业用途转载：需在转载内容的显著位置标注“本文/视频来源于JustVR，作者：[具体作者名]”，且不得修改内容的核心信息及完整性；
  Non-commercial reproduction: You must mark "This article/video is from JustVR, Author: [Specific Author Name]" in a prominent position of the reproduced content, and shall not modify the core information and integrity of the content;
• 禁止擅自修改：不得对平台内容进行剪辑、改编、翻译等修改后用于任何用途，除非获得作者的单独授权；
  Prohibition of unauthorized modification: You shall not edit, adapt, translate, or otherwise modify the Platform Content for any purpose unless you obtain separate authorization from the author;
• 商用申请渠道：如需商业使用平台内容，可通过本应用“联系我们”板块的邮箱contact@justvr.com与作者或平台运营方联系，申请商用授权。
  Commercial application channel: If you need to use Platform Content for commercial purposes, you can contact the author or platform operator through the email contact@justvr.com in the "Contact Us" section of this Application to apply for commercial authorization.

三、用户责任与违约责任 | III. User Liability and Breach of Contract Liability

如你违反本条款的任何约定，我们有权根据违规情节的严重程度，采取以下一项或多项措施：
If you violate any provisions of these Terms, we have the right to take one or more of the following measures based on the severity of the violation:

• 警告并要求限期整改；
  Issuing a warning and requiring rectification within a time limit;
• 暂停你的账号使用权限（临时或永久）；
  Suspending your account usage rights (temporarily or permanently);
• 删除你发布的违规内容或获取的不当数据；
  Deleting the illegal content you posted or the improper data you obtained;
• 追回因违规行为产生的非法收益；
  Recovering illegal gains arising from the violation;
• 向有关监管部门举报你的违规行为；
  Reporting your violation to the relevant regulatory authorities;
• 追究你的法律责任，要求你赔偿我们因此遭受的全部损失（包括直接损失、间接损失、律师费、诉讼费等）。
  Pursuing your legal liability and requiring you to compensate us for all losses suffered as a result (including direct losses, indirect losses, attorney fees, litigation fees, etc.).

四、协议的变更与生效 | IV. Modification and Effectiveness of the Agreement

我们有权根据法律法规的更新、业务发展需要或技术变革，适时修改本条款。如本条款发生重大变更，我们将通过本应用内公告、推送通知等方式提前通知你。修改后的条款自公告指定的生效日期起生效。
We have the right to modify these Terms from time to time in accordance with the update of laws and regulations, the needs of business development, or technological changes. In the event of major changes to these Terms, we will notify you in advance through in-Application announcements, push notifications, and other means. The modified Terms shall take effect from the effective date specified in the announcement.

你继续使用本应用服务，即视为你接受修改后的条款内容。如你不同意修改后的条款，应立即停止使用本应用。
Your continued use of the services of this Application shall be deemed as your acceptance of the modified Terms. If you do not agree to the modified Terms, you shall immediately stop using this Application.

五、争议解决与法律适用 | V. Dispute Resolution and Applicable Law

本条款的订立、履行、解释及争议解决均适用《中华人民共和国法律》（不包括冲突法规范）。
The conclusion, performance, interpretation, and dispute resolution of these Terms shall all be governed by the laws of the People's Republic of China (excluding conflict of laws rules).

如你与我们之间发生任何争议，应首先通过友好协商解决；协商不成的，任何一方均有权向本应用运营方所在地有管辖权的人民法院提起诉讼。
Any dispute arising between you and us shall first be resolved through friendly negotiation; if negotiation fails, either party has the right to file a lawsuit with the people's court having jurisdiction over the location of the operator of this Application.

六、其他条款 | VI. Other Provisions

本条款的无效或不可执行部分，不影响其余部分的效力。本条款未尽事宜，可由双方另行协商补充。
The invalid or unenforceable parts of these Terms shall not affect the validity of the remaining parts. Matters not covered in these Terms may be supplemented by both parties through separate negotiation.
